Your privacy is important to Code Cantina (“Code Cantina,” “us,” “our,” or “we”) and we need to collect certain information to provide our services to you. Please read this Privacy Policy (“Privacy Policy”) to understand how Code Cantina collects, uses, and/or shares your Personal Information (as defined below) when you use the website located at www.codecantina.com and the Wacky Casino app (“Wacky Casino”) and any Code Cantina-controlled social media pages (“Service”). Any capitalized words in this Privacy Policy that are not defined in this document are defined in our Terms of Service.

1. PERSONAL INFORMATION WE COLLECT AND HOW WE USE IT.
When you visit and/or use our Service, we may collect information from you automatically or information that is provided by you (“Personal Information”).

(a) Automatically Collected Information.
When you visit the Service, we automatically collect certain information that does not personally identify you but may uniquely identify the device you are using to visit the Service (e.g., your computer, tablet, or smartphone) (“Device”), including information about your web browser and your operating system and version. Additionally, as you use the Service, we collect information about how you interact with the Service.

(b) Information Provided by You.
When you contact Code Cantina or setup an Account you will need to provide your first and last name, email address, and username, which is considered Personal Information. You may also provide information if you email us or submit a support ticket through Wacky Casino.

How We May Use Your Personal Information:
i. To respond to the questions and inquiries you sent to us.
ii. If you opt-in, to send you occasional marketing information and newsletters and other email updates about Code Cantina (“Newsletters”). For instructions on how to opt-out of receiving Newsletters, please see Section 4.
iii. To administer promotions or giveaways that you have entered.

2. SHARING YOUR PERSONAL INFORMATION WITH THIRD PARTIES.

(a) Service Providers.
Like most companies, we use tools from third party service providers to help us with various parts of our business (“Service Providers”), and depending on the service we need, these Service Providers may have access to your Personal Information. For example, we may use a Service Provider’s email software to manage our Newsletter subscriptions, and if you have given us your email address to subscribe to the Newsletter, then your email address will be shared with that Service Provider. We may also use Service Providers for the following purposes:

i. To host the Service.
ii. To process payments.
iii. To deliver emails and newsletters.
iv. To help us conduct web analytics on the Service.

We contractually require all Service Providers treat your Personal Information as confidential information and to only use it for the services we need. However, we do not have direct control over how Service Providers use your Personal Information, and we cannot guarantee that our Service Providers will use your Personal Information as required in our contract with them. For this reason, we are not responsible for our Service Providers’ misuse of your Personal Information.

(b) Business Transfers.
As we continue to develop our business, we may reorganize as a business entity, acquire entities, subsidiaries, or business units, or enter into joint ventures with third parties. In any of these types of transactions, any information you provide may be one of the transferred business assets (subject to any pre-existing privacy notice unless you consent otherwise). If all or substantially all of our assets are acquired, or we merge with a third-party, your information will likely be one of the transferred assets. You understand and agree that we reserve the right to transfer any information collected from you in the case of any such transfer. In such event, we will use reasonable efforts to notify you before information about you is transferred and becomes subject to a different privacy policy.

(c) Legal.
We may disclose information you provide to respond to subpoenas, court orders, requests from authorities, and other legal processes, and to establish/exercise our legal rights. We may also disclose your information to defend against legal claims when we believe that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request. We may share your information in order to investigate, prevent or take action regarding illegal activities, suspected fraud, and situations involving potential threats to the physical safety of any person, violations of our Terms of Service, or as otherwise required by law.

3. HOW IS MY PERSONAL INFORMATION USED FOR ANALYTICS?

As an online business, it is important for us to know how users interact with our Service. We and our Service Providers will collect your location information and Device Information so that we can deliver our Service to our users, measure, analyze, and improve performance of the Service, and to continually update and develop our Service. For example, we will use this information to fix any bugs or errors in the Services and to determine if we need to support a new Device type for the Service.

4. OPTING OUT OF OR UNSUBSCRIBING FROM NEWSLETTERS.
If you wish to unsubscribe from receiving Newsletters, you can click on the “unsubscribe” link at the bottom of the newsletter email. Please allow up to 24 hours before you stop receiving newsletters. You may also continue to receive emails unrelated to marketing.

5. THIRD PARTIES AND THEIR POLICIES.
Throughout the Service, you may see links to third-party websites or applications. We are not responsible for the privacy practices of these third-party sites, and when accessing their sites, we encourage you to read their privacy policies.

6. DATA RETENTION.
Personal information collected from the Service may be stored and processed in the United States or any other country where Code Cantina or its affiliates, subsidiaries, or Service Providers maintain facilities. How long we store your Personal Information will depend on the purpose that we originally collected it. We will not retain Personal Information for longer than is necessary for our legitimate business interests or to comply with legal requirements. 7. SECURITY.
The security of your Personal Information is important to us. We follow generally accepted industry standards to protect your information, both during transmission and once it is received. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore, we cannot guarantee its absolute security. While no security system is completely secure, we and our Service Providers take appropriate security measures to protect against unauthorized access or disclosure of the information collected by us.

8. USERS UNDER 13.
The Service is not directed to children under the age of 13 and we do not knowingly collect information from children under the age of 13. If we learn that we have received any type of information from a child under the age of 13, we will delete such information. 9. ACCESSING, MANAGING, AND/OR UPDATING YOUR PERSONAL INFORMATION.
You can access, update, or correct some of your Personal Information directly in your Account settings on the Service if you have created an Account. If you cannot update your Personal Information in your Account settings or you do not have an Account, please contact us at info@codecantina.com.

10. FOR CUSTOMERS IN THE EUROPEAN UNION.
If you are a resident in an EU State, you have the right to access Personal Information we retain and to ask that your Personal Information be corrected, updated, or deleted. You additionally have the right to receive a copy of the Personal Information we have about you. If you would like to exercise these rights, please contact us by emailing info@codecantina.com.

Additionally, if you are a resident in an EU state, we note that we are processing your Personal Information in order to fulfill contracts we might have with you (for example if you make an order through the Service), or otherwise to pursue our legitimate business interests, such as direct marketing, to prevent fraud, and to conduct analytics on the Service. Additionally, please note that your information will be transferred outside of Europe, including to Canada and the United States. We rely on model contractual clauses and/or the Privacy Shield certification for such transfers.

We may update this Privacy Policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons. If we decide to change this Privacy Policy, we will update the date above.
